Drug Trafficking is when people intentionally sell, buy, make, deliver, possess or transfer a “trafficking limit” of drugs into Florida. Drugs include illegal controlled substances such as heroin, cocaine, prescription drugs and more. The trafficking amount depends on the type of drug.

The Florida Statute states that anyone who agrees, conspires, or confederates with another person or people to conduct any illegal drug sale or trafficking offense commits the offense of criminal conspiracy.

CONSEQUENCES OF CONSPIRACY TO SELL OR TRAFFIC IN ILLEGAL DRUGS IN FLORIDA 

The consequences for engaging in a drug sale or trafficking conspiracy in Florida depends on the type and quantity of drugs involved in the offense. 

Florida uses a Criminal Punishment Code that ranks certain offenses to determine what their sentence should be. There are levels 1-10, and these levels correlate to a certain number of points. Point levels can translate to minimum allowable prison sentences.

For purposes of sentencing, the crime of conspiracy to sell or traffic in illegal drugs is determined one level below the ranking under the offense attempted, solicited, or conspired to.

For example, Sale or Delivery of methamphetamine is ranked as a second-degree felony carrying a Level 5 Offense Severity Ranking under the Florida Criminal Punishment Code. If you are charged with Conspiracy to Sell or Deliver methamphetamine, the offense will be assigned a Level 4 Offense Severity Ranking because it is one level below the criminal offense of Sale or Delivery.  You would then be given a sentence based on a Level 4 charge.
