Defense Attorney Gets Domestic Violence Case Dismissed and Beats Violation of Federal Probation Charge

Outcome of Domestic Violence Case in Miami:

 

Our client *Matthew had his domestic violence case completely dismissed. Attorney David Tarras was able to use this outcome to reinstate Matthew’s probation, which was one of the biggest wins of the case. The domestic violence battery charge put Matthew in jeopardy of federal violation of probation. Nevertheless, Attorney David Tarras was able to fight Matthew’s case and deliver one of the best outcomes possible.

Matthew is now reunited with his family and is working hard to obtain his HVAC license. He is able to continue his education and fulfill the remainder of his federal probation.

Client Concerns about Domestic Violence Case in Miami:

Matthew was very scared because of the grave stakes that the case posed. Because of certain circumstances that occurred when Matthew was younger, he was convicted for a federal crime. Prior to the situation that resulted in Matthew being charged for domestic violence, Matthew was in the process of fulfilling his federal probation.  So when Matthew got arrested for domestic violence, he was also charged with violating his federal probation. This situation had severe ramifications and Matthew could have been looking at several years of jail time as well as separate cases in the state and federal court systems.

Facts on Domestic Violence Case in Miami:

Matthew met a young lady on Facebook and began a romantic relationship with her. 3 months into the relationship, they got into an argument that occurred in Matthew’s car. Matthew’s ex-girlfriend alleged that he strangled her during the altercation. When the police came on the scene, Matthew told law enforcement that his ex-girlfriend was trying to spit on him and that he was trying to block her from doing so. The police ended up taking Matthew into custody and charging him for domestic violence battery.

Strategy to Fight Domestic Violence Case in Miami:

Matthew was referred to Attorney David Tarras from the Rossen Law Firm by a relative of his current girlfriend. She works for a federal office and often saw David’s name in her case files. When Matthew met with David, Matthew immediately felt comfortable with David and trusted him with the case.

David began his case by trying to take depositions of the alleged victim. Despite multiple efforts to contact the alleged victim on David and the prosecution’s part, the alleged victim did not respond nor showed up to court. Since the alleged victim was also the primary witness, the prosecution’s case was severely weakened. This gave David a lot of room to mitigate the case and negotiate with the prosecution.

David’s tenacious efforts led to the entire domestic battery case being dismissed. David then took this result to federal court and fought to have Matthew’s probation reinstated. Despite aggressive opposition from the prosecution and the judge’s aversion to reinstate the probation, David was eventually able to achieve a major win and keep Matthew out of jail.
