Summary:

The client was on a website for gay men when he was contacted by a 21-year-old man. However, it turns out the man was underage and was lying. The client was accused of soliciting a minor, but after the Rossen Law Firm came in, there were no charges filed.

Facts of the Case:

A 69-year-old man joined a website for gay men called “Adam for Adam.” He had been alone with very bad health problems for the past 2 years. He has congestive heart failure and has been on Social Security Disability Insurance since 2008 and then private disability insurance since 1993. He explained that he doesn’t date because of his bipolar issues. While on the website, the client was contacted by a man that initially said he was 21-years-old but then changed his profile to 20-years-old. A few days later, the client got the feeling that the man was actually younger than he said he was. After the man sent him a nude photo, the client told him that he was underage and needed to stop. The man proceeded to admit that he was in fact 17-years-old but sent another picture anyway. The client was trying to get rid of the man and didn’t want him to show up at his building, but the man was very aggressive. During all of his interactions—over the span of just around 3 days—the client never talked to the man over the phone. They had only texted each other. Later on however, the client received a call from the man’s father, calling on the man’s phone number. The father claimed that his son had been on his way to see the client when he got into a car crash and wrecked his mother’s car. After that initial call, the father had been calling the client quite frequently. The client was accused of soliciting a minor.

Process and Result:

The client had an in-person strategy session with lead attorney Manny Serra-Jovenich. His sister and Havanese therapy dog went with him. Both the client and sister brought up their belief that the whole situation could just be a scam. The client expressed that the texts between him and the man were salacious and could be interpreted as inappropriate. He was extremely worried about being charged with a crime or investigated in any manner, so Manny went above and beyond in this case to ease their concerns. There was a grid search done to see if any reports or 911 calls had been made at all referencing the client’s address. There was even a call made to the man’s phone to speak with the father on settling the allegations. It was noted that there have been no contacts from the victim since Manny sorted everything through.

Final Result:

Ultimately, it was determined that the whole situation seemed to be a scam that was played on the client. After the client came to the Rossen Law Firm, Manny helped figure everything out so that neither the victim nor law enforcement officers contacted the client. And in the end, the State Attorney’s office did not go through with prosecution and there were no charges brought against the client.
