How Does a DUI Affect My Nursing License in Florida?

A DUI arrest or conviction in Florida can potentially impact your nursing license, but the severity of the consequences depends on various factors. Here's a breakdown of what you can expect:

Possible Consequences:

  • Board Investigation:  The Florida Board of Nursing (BON) may investigate any DUI arrest or conviction involving a licensee. They will review the details of the case, including the BAC level, whether there were any accidents or injuries involved, and your prior disciplinary history (if any).
  • Disciplinary Action:  Depending on the outcome of the investigation, the BON could take various disciplinary actions, including:
  • Reprimand: A formal warning from the BON.
  • Probation: Placing your license on probation with specific requirements, such as substance abuse evaluation and treatment.
  • Suspension: Temporarily suspending your nursing license.
  • Revocation: In extreme cases, the BON may revoke your nursing license.

Factors Affecting Consequences:

  • Severity of the Offense: A first-time DUI with a low BAC is less likely to result in harsh consequences compared to a repeat offense or one involving a high BAC or an accident.
  • Your Cooperation:  Demonstrating a proactive approach by completing substance abuse treatment or counseling programs before the BON investigation can show your commitment to rehabilitation.
  • Prior Disciplinary History: If you have no prior disciplinary actions against your license, the BON might be more lenient.

What to Do:

  • Report the DUI: You are obligated to report the DUI arrest or conviction to the BON within 30 days, regardless of the outcome of the criminal case. Failure to report can lead to disciplinary action.
  • Consult an Attorney: An attorney specializing in healthcare professional licensing can advise you on your rights and represent you during the BON investigation. They can help navigate the process and potentially advocate for a more favorable outcome.

My husband and I cannot thank Rossen law firm enough. They are a team of professionals that really genuinely care about their clients. Their guidance and support throughout the whole process was invaluable. Their attention to customer service was outstanding. Whenever I had a question about the case, they always were there to answer our questions in detail. We always had a call back in the same day, even if they weren’t available at the moment. We are extremely thankful to Rossen Law Firm for their outstanding work in the case and would definitely recommend them with my eyes closed. Thank you guys for getting our case dismissed. Special thanks to our lawyer Manny and to the rest of the team, who were always there to answer our questions Danielle, Gretchel, Anurka, and Peyton. Thank you Adam for having a team who are caring, dedicated, authentic and knowledgeable professionals in your firm and also for the event that your firm put together which was so relevant to our case. We will always be grateful.
