Summary:

A 17-year-old client was asked by her friend to smoke together. The client told the friend she had a brother who could sell marijuana to her. When the client arrived with her brother to the friend’s car, the brother immediately pointed a firearm at the friend. At some point, he made the client point the gun while he searched the friend’s pockets for money and valuables. The client was charged with robbery with a firearm and aggravated assault with a deadly weapon. She was sent to a juvenile detention center and later transferred to the Broward County jail. She received a withhold of adjudication and was placed on five years of probation with special conditions and counseling. The client ultimately had her probation shortened as a result of the work of the Rossen Law Firm team. 

Facts of the Case:

The client was called by her friend asking to smoke together at a certain location in Ft. Lauderdale. During their conversation, the client mentioned that her brother sold marijuana and that he could sell some to the friend. When the client and her brother arrived, both got into the friend’s car. The client was in the backseat and her brother in the front seat. Immediately upon entering the vehicle, the client’s brother pointed a firearm at the friend and demanded money and valuables. The brother struck the friend multiple times with the firearm. Then, he made the client point the gun at the friend while he stole money and valuables from the friend’s pockets. During this time, the client was repeatedly apologizing. Eventually, both the client and her brother fled the scene.

Process and Result:

The lead attorney on this case was Scott Simmons. The client was only 17-years-old at the time she was arrested and had no prior criminal history. She served time in a juvenile detention center and was even transferred to the Broward County jail. She entered a plea of no contest and received a withhold of adjudication on both counts. She was placed on probation for five years, with special conditions including no drugs or alcohol, enrollment in a GED program or high school, no contact with the victim or the victim’s family, Sexual Intake Assault Treatment, and counseling at a wellness center. The client complied with all of her probation conditions and had no violations. As a result, Scott filed a motion for early termination of probation. The motion was granted by the court and the client did not have to fulfill the entire five years of probation.

Final Result:

The client ultimately was not sentenced to prison and received a shortened probation time for her involvement in a robbery and aggravated assault.
