Summary:

A 23-year-old male in Coconut Creek was accused of possession with intent to sell and various other drug-related charges. These charges included contributing to the delinquency of a child. After proving that there was no evidence to directly correlate our client to this crime, the charges were declined. Our fantastic attorney, Scott Simmons, worked very hard to prove our client was not guilty through multiple strategy sessions and effective defense. 

Facts of the Case:

This case came into fruition when a father who resides in Coconut Creek informed the police that his daughter was being sold narcotics from a drug dealer, who was delivering the narcotics to his house when he was not present. The father turned in his daughter’s phone, which was filled with text messages between her and an anonymous phone number, which appeared to be the number of the drug dealer. The police officer used the phone to disguise himself as the daughter, and texted with the number to order various drugs and schedule a time to meet-up. When the drug dealer texted the phone with his location and car make, the police officer conducted a traffic stop and detained all occupants from the vehicle. The contents of the vehicle included various narcotics, and was parked within a significant range of a school.  Our client was a rear passenger in the vehicle, and all three of the passengers faced the same charges regardless of level of involvement. This is a very important fact in this case considering our client had no contact with the young girl and was merely a passenger in the vehicle. 

Process and Result:

There were multiple strategy sessions conducted for this case in order for attorney Scott Simmons to gain background and insight on our client’s involvement and personal history. These sessions revealed that the client works in construction and has a young child that he works to care and provide for. Our client claimed that he had no idea about the conversations the drug dealer was having with the young girl, and had never met her before. A Motion for Substitution of Counsel was filed in order for Scott to serve as counsel in the case.

Final Result:

The charges for this case were ultimately declined by the state attorney as a result of the argument made by Scott Simmons. There is also no substantial evidence that attributes our client to the phone conversations that attranged the drug deals, and he made no admission regarding ownership to the narcotics in the vehicle. Overall, due to the diligence and effort to present these facts from Scott, this case ended in a great result for our client.
