Probation instead of Prison for South Florida Felony Insurance Fraud Charge

Felony Insurance Fraud charge given probation instead of Prison time

Outcome of Felony Insurance Fraud Case:

Even though our client,  Megan J., admitted to committing Insurance Fraud, we were able to avoid jail time altogether on her case.

We also got Megan’s probation terminated early, so that she only served 9 months instead of the full 18 months she was initially sentenced with.

We also sealed her record so that she could continue on with her life and not have to worry about a criminal record or her employment options.

Client Concerns During Felony Insurance Fraud Case:

Megan was scared of going to prison, especially since she was facing a felony fraud charge. Megan was also worried about dragging her husband into a situation that he was not involved in.

Facts about the Felony Insurance Fraud Case:

Megan was driving around in Broward County when she got in a crash. Megan didn’t have insurance, so the next day she bought an insurance policy and then reported the crash a day later.

The insurance company thought that this was suspicious, and opened a fraud investigation into Megan. When the investigators started to question Megan, she admitted everything to them about why she bought the insurance.

(PS… If possible, it’s ideal to hire an attorney when the questioning starts so that you can tell the insurance company to talk to your attorney instead of giving them evidence to use against you! Of course, we can work with it either way, but that’s a tip if it's not too late for you)

Strategy to Fight the Felony Insurance Fraud Case:

When Megan realized what she had admitted to the insurance investigators, she hired Rossen Law Firm immediately. Megan had put the insurance policy in both her and her husband’s name, so the company also began investigating her husband to see if it was his fault.

We made sure that the husband was not arrested and made sure he knew not to speak to the investigators. We talked to the prosecutors pressing the charges against Megan and were able to coordinate Megan’s arrest so that she was able to turn herself in and then bond herself out right away so she didn’t have to spend much time in jail at all.

Instead of getting jail time for her felony insurance fraud case, we were able to work out a deal with the prosecutors to give Megan 18 months of probation instead.
