The New Florida Super Speeder Law: What You Need to Know From a Criminal Defense Attorney

No, not your average “5 miles over the limit” kind of speeding. I’m talking about the new Florida Super Speeder Law, which took effect on July 1, 2025, and has already led to arrests. You read that right—arrests. Because as of now, what used to be a civil traffic infraction has been turned into a criminal offense.

Let’s break this down so you understand precisely what this law means, how it works, and what to do if you’re ever pulled over or arrested for a Super Speeder violation in Florida.

What is Florida’s Super Speeder Law?

Just minutes after midnight on July 1, a driver was arrested on I-4 near Orlando going 104 mph in a 70 mph zone. That driver became one of the first people arrested under Florida’s new “Super Speeder” law, officially known as House Bill 351.

Before this law, speeding, even by 50 mph or more, was a civil infraction. You’d get a ticket, maybe face a fine, and move on. But now? That same action is a criminal offense with potential jail time, steep fines, and even a mandatory court appearance.

Let me say that again: excessive speeding is no longer just a ticket. It’s a crime.

Under the law, anyone who:

  • Drives 50 mph or more over the speed limit, or
  • Drives 100 mph or more in a way that threatens safety or interferes with other vehicles

can now be charged criminally.

What Are the Penalties for a Super Speeder Violation in Florida?

The penalties under the new law are no joke. Here’s how it breaks down:

First Offense:

  • Up to 30 days in jail
  • A $500 fine
  • Or both

Second or Subsequent Offense:

  • Up to 90 days in jail
  • A $1,000 fine
  • Or both

And if you’re convicted of dangerous or excessive speeding again within five years, your driver’s license will be revoked for at least six months, and possibly up to a year.

To make matters even more serious, if you’re caught going 50+ mph over the limit, you can’t just pay a ticket and be done. A mandatory court appearance is now required—either by you or your attorney. In other words, you now need a Super Speeder Defense attorney who knows how to navigate these cases and protect your rights.

What Should You Do If You’re Pulled Over for Dangerous Excessive Speeding?

First, take a breath. Stay calm. The way you handle the traffic stop can make a big difference.

Here’s what I tell all my clients:

  1. Pull over safely and promptly. Use your turn signal, and don’t make any sudden movements.
  2. Be polite and cooperative, but don’t admit guilt. You have the right to remain silent. Use it.
  3. Avoid answering questions about how fast you were going. Don’t try to talk your way out of it.
  4. Ask for the officer’s name and badge number, and jot down everything you can remember after the stop—what they said, how they acted, what equipment they used to clock your speed.
  5. Call a criminal defense attorney right away.

Just because you were pulled over doesn’t mean you’re automatically guilty. And just because an officer says you were speeding doesn’t mean they have all the evidence to prove it.
