The officer made Felipe A. do a series of field sobriety exercises, which he noted in his report that Felipe failed miserably. The field exercises were not on video. The officer arrested Felipe and took him to a BAT facility where Felipe was put on video to take a breathalyzer test.

Once we gathered all of the evidence, including the video from the BAT facility, it contradicted the police officer’s account in his police report that Felipe was impaired. On video at the BAT facility Felipe looked very sober and did the field sobriety exercises much better than indicated in the officer’s report.
